1. General
hermaid – Menopause Companion
1.1 Her-Medical-Aid GmbH, Entrepreneurship Hub Halle 21, 1st floor, Room A1-22, Schwartzkopffstraße 1, 15745 Wildau, Germany, registered with the Cottbus Local Court commercial register under HRB 19579 CB (hereinafter "hermaid"), operates the hermaid – Menopause Companion app (hereinafter the "App").
1.2 These Terms of Use govern the contractual relationship between hermaid and users of the App.
1.3 By registering and/or using the App, a contract for the use of the App under these Terms of Use is formed between the user and hermaid.
1.4 The App is a CE-certified medical device that serves as a digital companion for women experiencing symptoms related to hormonal changes, as well as peri- and postmenopausal symptoms.
1.5 Users are required to carefully review these Terms of Use and the Privacy Policy before using the App. By registering, or at the latest by first using the App, users agree to be bound by these Terms of Use.
The App does not constitute and does not replace medical treatment or diagnosis. In case of acute symptoms, please contact emergency services (112 in Germany) or a medical facility.
Users must be of legal age and have full legal capacity. The offering is intended exclusively for natural persons.

2. Registration and User Account

2.1 Registration requirements
Prior registration is required to use the App. Only persons of legal age with full legal capacity may register.
2.2 Proof of eligibility
If registration occurs as part of an employer access program and there is a corresponding agreement between hermaid and the relevant company (hereinafter "employer"), hermaid is entitled to require use of a company email address or entry of an access code (voucher) provided by hermaid to verify eligibility.
Registration data or usage data of the user is not shared with the employer, unless and to the extent there is a legal obligation to do so.
2.3 Information provided during registration
Data requested during registration must be provided completely, accurately, and kept up to date. Users must promptly update any changes in their profile.
2.4 Responsibility for the user account
Users must keep their login credentials confidential and protect them from unauthorized access. Users bear sole responsibility for actions taken through their account.
2.5 Account uniqueness and transferability
Only one user account is permitted per person. The user relationship is strictly personal; the account may not be transferred or inherited.
2.6 Rules of conduct
The App may only be used for the purposes set out in these Terms of Use and only in a manner permitted by law.
In particular, the following are prohibited:
using the App for unlawful, abusive, or unauthorized purposes,
actions that could impair the security, integrity, availability, or functionality of the App or the underlying technical systems, unauthorized use of other users' accounts or sharing one's own login credentials with unauthorized third parties, as well as the use of automated systems, software, scripts, or other technical tools for unauthorized data collection, manipulation, or misuse of the App.
hermaid is entitled to take appropriate measures in the event of violations of the above provisions, in particular to block content, temporarily restrict access, or suspend or delete the user account in accordance with these Terms of Use.
2.7 Account closure
Users may have their account deleted at any time by contacting support@hermaid.me.
3. Technical Requirements
3.1 Platform availability
The App is provided for mobile devices on iOS and Android. Hosting takes place on EU servers (Hetzner, Germany).
3.2 Further development and updates
hermaid is entitled to further develop the App technically and in terms of content at any time. There is no obligation to provide specific updates or to permanently maintain specific features.
3.3 User responsibility
Users are responsible for maintaining a functioning internet connection and ensuring their device is compatible. Any connection costs incurred are borne by the user.
4. Data Protection and Consent
4.1 Principles
hermaid processes personal data, including health data, exclusively in accordance with the GDPR and applicable national data protection laws. All transmissions are SSL/TLS encrypted; data is stored on EU servers.

5. Rights and Obligations of Users
5.1 Rights
Users are entitled to use the App and its features in accordance with these Terms of Use. They have access at all times to the data they have entered and may view, correct, or update it.
5.2 Obligations
The App may only be used for its intended purpose
Actions that impair the security or integrity of the App must be avoided
Technical manipulation and unauthorized access to hermaid's systems are prohibited
Login credentials must be kept confidential
5.3 Legal consequences of violations
Violations may result in warnings, temporary suspension, or permanent deletion of the account. hermaid reserves further legal rights.
6. Services Available in the App
6.1 Service offering
Depending on the applicable license scope, the following functions and services are available to users through the hermaid app, among others:
Recording of health-related information as part of a digital intake using structured questionnaires,
keeping a symptom journal and displaying progress visualizations,
providing an AI-powered chat function for general assistance and support in using the App; this does not replace medical advice, treatment, or diagnosis and is not intended to answer individual medical questions; users are informed that they are interacting with an AI system,
booking consultation appointments with qualified professionals; these may be included or charged separately depending on the license booked,
conducting telemedicine video consultations with medical professionals,
providing general educational content and information, in particular on nutrition, sleep, mental health, and exercise; these do not constitute personalized medical recommendations, as well as voluntary participation in scientific studies.
The specific scope of functions available in the App depends on the license booked, hermaid's current service offering, and technical availability.

6.3 Premium services and paid services
hermaid is entitled to offer certain features and services of the App only against separate payment. This applies in particular to consultation appointments and other add-on services. Basic features of the App may be provided free of charge. The applicable prices, scope of services, and billing terms are shown in the App before booking or using the paid service.
6.4 Payment terms
6.4.1 If paid services are purchased by self-payers through the Apple App Store or Google Play Store, payment processing is handled through the respective store. In this case, the terms of use and payment terms of the respective store provider additionally apply.
6.4.2 If services are used as part of an employer license program, billing is handled directly through the respective employer based on the agreement between hermaid and the employer.
6.4.3 Payment processing for teleconsultations is handled through hermaid's payment service provider, Stripe Payments Europe, Limited, Dublin.
6.4.4 As part of payment processing, health data is not transmitted to payment service providers or other third parties for payment purposes. This does not affect information whose transmission is strictly necessary in individual cases to technically carry out the payment process or to fulfill legal obligations.
6.5 Medical notice
The App offers consultations with qualified professionals but does not replace personal medical treatment, examination, or diagnosis. Users are required to seek medical advice in case of illness.

Service hours: Monday–Friday, 9:00 AM–6:00 PM.
Support answers technical questions about the App, its features, booking, and administrative matters. It does not replace medical advice.
9. Liability
9.1 hermaid develops and operates the App with due care. Nevertheless, it cannot be ruled out that technical limitations, interruptions, or errors may occur in individual cases.
9.2 hermaid is liable without limitation for intent and gross negligence, for damages arising from injury to life, body, or health, under the provisions of the Product Liability Act, and to the extent of any expressly assumed guarantee.
9.3 In the case of slightly negligent breach of material contractual obligations, hermaid is liable only for the typical, foreseeable damage. Material contractual obligations are those obligations whose fulfillment makes the proper use of the App possible in the first place and on whose observance users may regularly rely.
9.4 Otherwise, hermaid's liability for slightly negligent damages is excluded to the extent permitted by law.
9.5 hermaid does not guarantee that the App will be available at all times without interruption, delay, or completely error-free. This applies in particular where limitations or outages are due to circumstances beyond hermaid's control, such as disruptions to telecommunications networks, internet connections, mobile devices, app stores, or services of external technical providers.
9.6 To the extent hermaid is responsible for a loss of data, hermaid is liable only for the effort of restoration that would also have been necessary with reasonable data backup on the part of the user.
9.7 The above liability provisions also apply in favor of hermaid's legal representatives, employees, and vicarious agents.
10. Changes to the Terms of Use
10.1 hermaid is entitled to change these Terms of Use at any time with effect for the future, provided there is a valid or objective reason and the change is reasonable for the user.
Such a reason exists in particular in the case of:
10.2 hermaid will inform users of intended changes in text form at least six weeks before their planned entry into force.
10.3 If the user does not object to the announced changes in text form within six weeks of receiving the notice of change, the changes are deemed accepted.
10.4 If the user objects in due time, hermaid is entitled to terminate the user relationship as of the announced effective date of the changes, or alternatively with reasonable notice, provided that continuing the unchanged contract is not reasonable for hermaid.
10.5 Changes to material service characteristics, main contractual obligations, agreed fees, or separately granted data protection consents are not made via deemed consent, but only with the express consent of the user, unless a legal basis permits such a change.
10.6 hermaid's right to further develop, adapt, restrict, or discontinue the App and individual features in accordance with these Terms of Use and applicable law remains unaffected.
11. Copyright
All content, information, images, databases, and computer programs published within the App are protected by copyright and are the property of hermaid. Any use beyond this requires the prior express written consent of hermaid.
12. Right of Withdrawal
To the extent a statutory right of withdrawal applies when booking paid services, the withdrawal period is generally 14 days from the conclusion of the contract. If the user expressly requests that hermaid begin performing the booked service before the withdrawal period expires, and the service is fully performed before the withdrawal period expires, the right of withdrawal lapses if the user has previously confirmed that they are aware that the right of withdrawal lapses upon full performance of the contract. If the service is only partially performed before the withdrawal period expires, compensation for value may be owed for the services performed up to the withdrawal, provided the legal requirements for this are met.
13. Final Provisions
German law applies.
14. Severability Clause
Should individual provisions of these Terms of Use be or become wholly or partly invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the applicable statutory provisions.
